Conditions of membership:

 

  1. ADMINISTRATION FEES & CONDITIONS
    1. An administration fee of R3.50 per month as determined from time to time as well as premiums in respect of Group and Funeral Insurance are payable on a monthly basis. Card transactions are subject to a levy (as determined from time to time) which will appear on the monthly statement.
    2. Monthly contributions in respect of the Guarantee Fund for consumer members are compulsory, and, if needed, can be utilised for payment of debt due by the member to Koopkrag Limited.
    3. Participation in the Funeral and Group Insurance schemes are optional.
  1. USE OF CARD

    The use of a Koopkrag purchase card is subject to the following conditions:

    1. The use of a card is limited to the card holders (the member and the persons to whom additional cards were issued on request of the member on his Koopkrag account). The member is responsible for all purchases made on any of the cards issued in respect of his Koopkrag account.
    2. The cardholder shall on receipt of the card sign the card in the space provided with a ballpoint pen.
    3. The card remains the property of Koopkrag Limited and the member shall surrender and return any card issued on his request on his account, to Koopkrag Limited on demand.
    4. The holder of the card shall not cede or assign any of his rights, or obligations in respect of the card and/or the use thereof to a third party.
    5. The approved monthly purchase limit may not be exceeded without the consent of Koopkrag Limited. If, however, the purchase limit is exceeded, the member will still be liable to Koopkrag Limited and a fee of R15.00, or a fee as determined from time to time, will be charged.
  1. PROTECTION OF CARD
    1. The member shall take proper care of the card(s) issued on his account and exercise all necessary precautions to prevent the loss and/or the theft thereof.
    2. In the event of theft of the card or the use of the card by an unauthorized person or if the member has reason to believe that any of the aforementioned events have occurred, the member must notify Koopkrag Limited without delay. If such notification should be carried out verbally, Koopkrag Limited may request the member to confirm such notification in writing before a replacement card will be issued.
  1. LOST CARD PROTECTION
    1. The member confirms that he is aware of the Purchase Card Protection Fund offered by Koopkrag Limited and that he must apply in writing for protection under the scheme.
    2. In terms of Koopkrag Limited's Purchase Card Protection Fund scheme, the member accepts liability for all payments made by Koopkrag Limited or which Koopkrag Limited is bound to make in respect of, or arising out of, any use of the card before Koopkrag Limited is reasonably able to act on the notification or prior to the written confirmation as referred to in clause 3.2. The member acknowledges that any loss(es) suffered as a result of deliberate behaviour or negligence on the part of the cardholder, shall not, because of the notification, absolve the member of liability.
  1. PROOF AND AUTHORISATION TO DEBIT MEMBER'S ACCOUNT
    1. Apart from clauses 3.2 and 4 hereof the member shall be liable to and reimburse Koopkrag Limited for all payments made by Koopkrag Limited or which Koopkrag Limited is bound to make in respect of, or arising from purchases made by means of the card irrespective of whether the relevant voucher(s) is signed by the card holder or not.
    2. The member must sign a credit voucher in respect of each refund, which has been allowed by a Supplier on each applicable occasion the card was used. By signing such a voucher, the member confirms that the information contained therein is correct.
    3. Apart from clauses 3.2 and 4 hereof, the member irrevocable authorises Koopkrag Limited to pay for any purchases made and/or services obtained by means of the card and to debit the amount concerned to the member's account.
  1. CLAIMS AND DISPUTES
    1. Any claims or disputes between the member and any Supplier with regard to any goods or services acquired from the Supplier, shall in no way affect Koopkrag Limited's right to receive payment from the member since the member acknowledges that no supplier is an agent of Koopkrag Limited.
    2. The member shall not be entitled to countermand any payment made, or to be made, by Koopkrag Limited in respect of any transaction entered into by the use of the card.
  1. INTEREST & OTHER CHARGES
    1. The member shall be liable to Koopkrag Limited for payment of interest on any outstanding amount at a rate as determined by the Board of Directors of Koopkrag Limited from time to time and it shall be capitilised and included in each monthly statement issued to the member.
    2. Should payment of an account be received after the 3rd day or another day as determined from time to time of any month, and subject to clause 8.1 hereof, the following provisions will come into effect:
      1. Koopkrag Limited will be entitled to add 1.67% interest per month or such other percentage as Koopkrag Limited may decide upon to the outstanding balance of a member's account.
      2. Notwithstanding sub-paragraph (a) accounts handed to attorney's for collection will be debited with interest at the rate of 20% per annum or such other percentage as Koopkrag Limited may decide upon.
    3. Should a member's buying facility be cancelled due to late payment, non-payment or any other misdemeanour, then such a member will forfeit all bonus benefits whether such benefits have accrued or not.
  1. MONTHLY STATEMENTS AND PAYMENTS
    1. Koopkrag accounts are payable not later than the 3rd or another date as determined from time to time of each month, following the month in which the Koopkrag account is dated, per debit order or at the offices of Koopkrag Limited or at a duly authorised agent of Koopkrag Limited, appointed in writing. Payments received after the 3rd or another date as determined from time to time of the relevant month shall not qualify for bonus, however, should a payment be received per post after the 3rd or another date as determined from time to time of the relevant month it will qualify for bonus purposes, providing the envelope containing the payment was posted on or before the 1st day or another date as determined from time to time of the month concerned.
    2. The member must raise any query regarding the correctness of the monthly statement in writing within 30 days of the monthly statement, failing which the member shall have no claim whatsoever in respect thereof.
    3. Any latitude, concession or extended period of payment granted to the member by Koopkrag Limited shall not in any way constitute a novation or waiver by Koopkrag Limited of its rights in accordance with the conditions of use, neither shall it give rise or have the effect of ESTOPPEL against Koopkrag Limited.
  1. WAIVER
    1. The member, Surety, Authorised User and/or Nominee hereby renounce the benefit of the legal exception, excursion, division, cession of action, non cause debit, no value received, revision of accounts, de duabus vel pluribus reis debendi and all other exceptions which might or could be pleaded in defence and the member, Surety, Authorised User and/or Nominee acknowledge to be fully acquainted with the meaning and effect of all the aforesaid exceptions.
    2. Should it become necessary for Koopkrag Limited to hand an account of a member over to attorneys for collection, because of non-payment or any other reason, the following provisions will apply:
      1. The member will be responsible for all costs, including attorney and own clients fees as well as tracing costs and predetermined administration costs of 10% of the entire amount owing when handed over to the attorneys.
      2. Should any court action arise from this agreement, the member accepts the jurisdiction of the local magistrate, irrespective of the amount involved, and choose as his domicillium citandi et executandi his residential address as stated in this agreement. Notification in writing means a notification which has been faxed, delivered to Koopkrag Limited by registered post or by the member personally.
  1. REVOCATION AND TERMINATION
    1. Koopkrag in its sole discretion may at any time and without supplying any reasons therefore and without releasing the member or, where applicable, the surety, from any liabilities to Koopkrag Limited in respect of any previously extended credit or any use of the card, revoke or cancel the card facility or require the member to return the card to Koopkrag Limited. Koopkrag Limited may call for immediate repayment of the full amount outstanding on the member's account when the card facility is revoked.
    2. Any travelling expenses incurred to recover a card resulting from breach of contract, shall be recoverable from the member involved at the rate of R1.60 per kilometre or such rate as determined from time to time.
  1. ADDRESS
    1. Members' address mentioned herein is chosen as DOMICILLIUM CITANDI ET EXECUTANDI and any change of address must be done in writing.
    2. If applicable, I agree to the implementation of an emoluments attachment order in accordance with section 65J(2) of the Magistrate's Court Act of 1944, to an amount as previously agreed upon in this agreement, and that this amount may be subtracted from my salary and paid to the plaintiff's attorney.
    3. Where the account is in the name of both the husband and wife, both parties will collectively and individually be responsible for the payment of the account.
